Terms and conditions
General terms and conditions
1. Scope
These general terms and conditions apply to all orders placed through the Hardware König online shop.
The offer is addressed to consumers and businesses. A consumer is any natural person who enters into a legal transaction predominantly for purposes that cannot be attributed to their commercial or independent professional activity. A business is a natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when entering into a legal transaction.
2. Conclusion of the contract
The presentation of products in the online shop is not a legally binding offer, but an invitation to place an order. By completing checkout, the customer places a binding order for the goods in the shopping cart. The contract is concluded when Hardware König expressly accepts the order or dispatches the goods.
3. Prices and payment terms
All prices quoted are final prices and include statutory VAT where applicable. Any additional shipping costs are displayed to the customer before the order is placed.
Payment options include PayPal and card payments through Stripe. The available payment methods are displayed to the customer during checkout.
4. Delivery and shipping
Delivery is made to the address provided by the customer. Delivery times and any shipping costs are shown in the relevant offer or during checkout.
5. Retention of title
The goods remain the property of Hardware König until the purchase price has been paid in full.
6. Statutory warranty rights
The statutory warranty rights apply.
7. Right of withdrawal for consumers
Consumers generally have the statutory right of withdrawal. Details are set out in the separate information on withdrawal available on our website.
8. Liability
Hardware König has unlimited liability for intent and gross negligence and for damage resulting from injury to life, body or health. Otherwise, the statutory liability provisions apply.
9. Applicable law
The law of the Federal Republic of Germany applies. For consumers, this choice of law applies only insofar as it does not restrict mandatory consumer protection provisions of the country in which the consumer has their habitual residence.
10. Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
11. Contract language
The language available for concluding the contract is German.
12. Storage of the contract text
Order data are stored in accordance with legal requirements. The customer receives the order data and the information relevant to the contract electronically as part of order processing.
13. Final provisions
If individual provisions of these general terms and conditions are or become invalid, the remaining provisions remain unaffected. Otherwise, the statutory provisions apply.
